Wow. Tuesday’s elections were TERRIFYING for MAGATS. 😂🤣😂 People are tired of the MAGA extremism and just plain meanness. They are VICIOUS to ANYONE that isn’t in lockstep agreement with them. Saying THERE WAS NO VICTIM OF FRAUD IN THE TRUMP CASE is wrong. The victim here is the New York City government who was deprived of taxes, because Trump corps systematically overvalued properties for profit. The for taxation purposes, Trump corps systematically undervalued properties to avoid/minimize paying taxes. Michael Cohen who used make the financcial statements for the Trump corps was penalized with 2 jail terms because of this. The USD 250 million base value is the minimum estimated value that the Trump corps, deprived the government of. Also, it wasTrump's lawyers who declined the presence of jury in the process of examining the official documents drawn up (from Trump orgs submitted to the government in the past years).😮

Trump screws the IRS by undervaluing his properties and screws the banks by overvaluing his properties to get better interest rates. Trump even claimed his Trump tower penthouse was three times as big as it really is.

Systemic issues with this NY fraud case:
– Treating him as a criminal in a civil proceeding
– Allowing fraud to be proven without intent
– Allowing fraud to be found without an aggrieved party
– Allowing fraud to be proven at a standard of less than beyond a reasonable doubt
– Allowing fraud to be found without damage to anyone
– Allowing fraud to be determined via summary judgment when the material facts are in dispute and the consequence is punitive monetary damages
– violation of the 7th Amendment requiring a jury for a case resulting in criminal punishment
– the state has no standing
– the state has no damage/remedy
– attempting to implement punitive fines and calling it “establishing damages”.
– conflating and equating fines with the amount of the alleged disparity of values in the real estate
– only the banks and/or affected insurance companies have standing to prove civil fraud
– issuing a gag order in a non-jury trial
– the judge said the court is sitting in equity, not law. Equitable remedies are usually injunctions or specific performance. Damages are not sought and are not a feature of equitable proceedings.
The statute relied upon contemplates a previous finding of criminal fraud. The statute is not meant to be used as a vehicle to to find the fraud itself. Also, reliance on a statute (law) for satisfaction is a legal action, not an equitable one.
If $250M to $1B in levied in fines against Trump, who gets the money? Are they going to turn around and give it to the banks and insurance companies who were allegedly defrauded. It’s certainly not the state’s right to that money, and it’s illegal for the state to keep it.
This case is bad all the around and is completely and utterly unconstitutional. Sadly, this has to play out to get real justice down the line. I hope he sues them all for malicious prosecution and defamation.
